Terms of Use

The terms governing your access to and use of Codebase Engineering websites and products.

1. Acceptance of Terms

By accessing or using any website, application, or service operated by Codebase Engineering ("we", "us", "our"), including codebaseengineering.com, tankcode650.com, and the IsoMetrics platform, you agree to be bound by these Terms of Use. If you do not agree, you must discontinue use immediately.

These Terms apply to all visitors, users, and subscribers of Codebase Engineering products and services.

2. About Our Products

Codebase Engineering develops and operates engineering calculation and project management software, including:

  • TankCode 650 โ€” An API 650 compliant storage tank design calculation platform.
  • IsoMetrics โ€” A piping isometric management and tracking platform.

Each product may have its own additional terms of service, which supplement these Terms. In the event of conflict, the product-specific terms take precedence for matters relating to that product.

3. Use of the Service

You agree to use Codebase Engineering services only for lawful purposes and in accordance with these Terms. You must not:

  • Use our services in any way that violates applicable local, national, or international laws or regulations
  • Attempt to gain unauthorised access to any part of our systems, accounts, or networks
  • Reproduce, duplicate, copy, sell, or exploit any part of our services without our written permission
  • Transmit any unsolicited or unauthorised advertising or promotional material
  • Use automated tools to scrape, crawl, or extract data from our platforms without explicit permission
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity
  • Introduce malicious software or interfere with the integrity or performance of our services

4. Professional Responsibility and Disclaimer of Engineering Liability

Important notice for engineering users: TankCode 650 and other Codebase Engineering products are tools intended to assist qualified engineers in performing calculations. The outputs of these tools do not constitute professional engineering advice or a certified engineering design.

You are solely responsible for:

  • Verifying that all inputs entered into the software are correct and appropriate for your specific project
  • Reviewing and validating all calculation outputs before use in any engineering design, drawing, or document
  • Ensuring compliance with the applicable edition and revision of any referenced standard (API 650, ASCE 7, IS 1893, etc.) as they apply to your jurisdiction and project
  • Obtaining any required professional engineering sign-off, review, or certification for your design

Codebase Engineering makes reasonable efforts to ensure calculation accuracy but makes no warranty, express or implied, that the outputs are free from errors, or that they are suitable for any particular purpose. Use of our tools does not replace the professional judgment of a licensed engineer.

5. Intellectual Property

All content, code, algorithms, design, trademarks, and other intellectual property on our websites and within our products are the exclusive property of Codebase Engineering or our licensors. You are granted a limited, non-exclusive, non-transferable licence to access and use our services for your internal business purposes only.

You may not copy, modify, distribute, sell, or lease any part of our software or services, nor may you reverse-engineer or attempt to extract the source code of our products.

6. Accounts and Subscriptions

To access certain features of our products you may need to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorised use of your account.

Subscription fees, billing terms, refund policies, and access levels are described in the relevant product's pricing documentation and are incorporated into these Terms by reference.

7. Data and Privacy

Our collection and use of personal data is governed by our Privacy Policy, which forms part of these Terms. By using our services, you agree to the processing of your data as described in that policy.

You retain ownership of any engineering data, project data, or calculation inputs you upload to or create within our platforms. We do not claim ownership of your data. You grant us a limited licence to store and process your data solely for the purpose of providing the service to you.

8. Uptime and Service Availability

We aim to provide a reliable service but do not guarantee uninterrupted availability. We may suspend or modify our services from time to time for maintenance, upgrades, or reasons outside our control. We will endeavour to provide advance notice of planned maintenance where possible.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Codebase Engineering and its directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use our services, including but not limited to loss of profits, loss of data, or damages arising from engineering decisions made based on our software outputs.

Our aggregate liability to you for any claim arising under these Terms shall not exceed the amount paid by you to Codebase Engineering in the twelve months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Codebase Engineering and its officers, directors, employees, and agents from any claims, damages, losses, and expenses (including reasonable legal fees) arising out of your use of our services, your violation of these Terms, or your infringement of any third-party rights.

11. Third-Party Services and Links

Our products and websites may integrate with or link to third-party services (e.g., payment processors, cloud providers). We are not responsible for the content, availability, or practices of third-party services. Your use of third-party services is governed by their own terms and privacy policies.

12. Modifications to These Terms

We may update these Terms at any time. When we make material changes, we will update the "Last Updated" date and, where appropriate, notify active subscribers by email. Continued use of our services after the effective date of changes constitutes acceptance of the updated Terms.

13. Termination

We reserve the right to terminate or suspend your access to our services at any time, with or without notice, if we have reason to believe you have violated these Terms. You may terminate your account at any time by contacting us. Provisions of these Terms that by their nature should survive termination (including intellectual property rights, limitation of liability, and indemnification) shall survive.

14. Governing Law and Jurisdiction

These Terms are governed by the laws of India. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Vadodara, Gujarat, India.
